Reviewing and challenging grades

Regulations on reviewing and challenging grades and amending the official records of examination results

 
Preamble

Section 37.1 i) of the University of La Laguna Statues, approved by Canarian Government Decree 230/2000, December 22 (BOC #170/2000), guarantees students the right to "to ask for a review of their examination results and to dispute them according to the internal regulations set by the Board of Directors".  In addition, section 38.2 of the same statutes gives the Board of Directors the competence to establish a procedure to review and dispute examination results, which is one of the changes in the statutes, as up until now this was established by the internal regulations of individual centres. The draft statute prepared by the University Senate in accordance with the Second Temporary Provision the Organic Law 6/2001, December 21, regulating universities, is similar to the original version and therefore it seems likely that its approval by the Canarian Government will not change the way it is written.

It is also necessary to regulate another two aspects affecting student's grades in order to fill in gaps in the regulations and resolve some issues that have been detected in practice, such as how long evaluation material should be saved (a very vague issue) and the procedure to amend the official record of examination results, guaranteeing the right of students to have an audience when such an amendment is detrimental to them. 

In compliance with the statute, and in consideration of the issues discussed above, the Provisional Governing Council (which replaces the Board of Directors pursuant to Organic Law 6/2001, December 21, regulating universities) approves these Regulations on Reviewing and Challenging Grades and Amending Examination Results.

Chapter I. Reviewing the exam with the professor in charge of the course


Section 1. The right to review exams with the professor in charge of the course

1.    Every student has the right to review all exams, tests or assignments carried out for their evaluation and to receive oral explanations about their grade from the professor. 
2.    This right can only be exercised after first requesting a review in person in accordance with the provisions of the following section. However, in exceptional situations that have been properly justified, the time and form in which the review is carried out may be modified.

Section 2. Review procedure

1.    Provisional grades will be published in a period of thirty days from the date of the examination and, in any case, in a period of no less than ten days before the date of the next examination of the same course. In addition to the grades, the date, hours and location of the review will also be published.
2.    The review period will start two working days after the publication of the grades and last for three business days, following a schedule that allows all interested students to be attended to.
3.    In serious cases, whose justification is documented, where the student is unable to attend, the review can take place during the two working days following the end of the review period, with prior consent from the professor.
4.    In terms of this section, Saturday is not considered a working day.


Section 3. Review

During the review the student will be personally attended to by the professor or professors who took part in the corresponding evaluation or by the professor who coordinated the course.

Section 4. Publication of the final grades

1.    The professor or professors  in charge of the course will publish the final grades, with any modifications that may have taken place, on the same day that the review period ends or, when necessary, on the following working day. If there are no changes in the provisional grades, these will become the final grades without having to be published again.
2.    The deadline for turning in the record of the examination results set by the official academic calendar approved by the Governing Council must be respected.


Section 5. Publishing the official record of the examination results

The secretary of the centre will specify the date that the records were received from the corresponding professor, professors or tribunal and will publish a copy on the designated notice boards.

Section 6. Challenging grades received for official examinations

If a student disagrees with the final grade of an official final examination, they can challenge it in the five working days after the publication of the records of the final examination results by submitting their reasons in writing to the secretary of the centre. This document should be directed to the dean or director of the centre so that they can decide whether or not the objection should be forwarded to the President of the Board assigned to deal with such matters. Saturdays are not considered working days in terms of this article.

Section 7. Composition of the Review Board

1.    The challenge will be resolved by a review board composed of the dean or director of the corresponding centre or the vice-dean or sub-director to whom this issue has been delegated and two professors with doctorates (except in sub-areas that only offer diplomas) who belong to the same academic area or sub-area of the course whose grading has been challenged or, if none exist, from similar academic areas. Both professors will be designated through a lottery carried out by the Dean or Director of the centre with the Secretary in attendance to bear witness. With previous notice, this lottery can be attended by the student and professor or professors involved.
2.    The president of the board will be the corresponding dean, director, vice-dean or sub-director and the secretary, who is the lowest ranking professor with the least amount of seniority.

Section 8. Conflicts of Interest

The professor or professors who issued the challenged grade cannot form part of the review board. To this end, the members of the board will be subject to sections 28 and 29 of Law 30/1992, November 26, on Public Administration and Common Administrative Procedure, which list the reasons for abstention and disqualification.

Section 9. Review Board procedures


1.    The president of the board will transfer the student's objection to the professor or professors in charge of the course so that within two working days from their notification they will submit a copy of the written exam or the notes taken during the oral exam, the material used for the evaluation and any allegations that they deem necessary.
2.    The allegations of the professor will be submitted to the student so that in a period of two working days from the notification they will be able to respond to them.
3.    The review board will issue a reasoned resolution in a period of two working days from their receipt of the documentation indicated in the prior articles and in a period that will never be less than fifteen working days prior to the next examination of the same course.
4.    The interested parties can renounce the periods established in the prior articles of this section.
5.    The president of the board will submit the resolution to the secretary of the centre so that the student, responsible professor or professors and the head of the department can be notified.
6.    When necessary, the Secretary of the centre will attach the final record of the examination results to the resolution, affixing it with a certifying stamp.


Section 10. Criteria used by the Review Board for the resolution


1.    In order to resolve the challenge, the review board will use the evaluation criteria outlined in the corresponding course plan, in accordance with the University of La Laguna Statutes.
2.    When the grade of an oral examination is challenged, the board may hold a new oral examination.

Section 11.  Appealing the resolution of the Review Board


The resolution of the review board can be appealed to the rector in accordance with the University of La Laguna Statutes and Law 30/1992, November 26, on Public Administration and Common Administrative Procedure.

Chapter III. Saving tests and exams


Section 12. Obligation to save tests and exams


1.    Exams, tests, coursework, notes on oral exams and copies of multiple choice exams or the like must be saved until the end of the following academic year.
2.    In cases where grades are challenged before a review board, the secretary of the board must save the exams or notes until the final resolution of the administrative or jurisdictional appeals that can be made.

Chapter IV. Amending the official records of examination results


Section 13. Amending the official records of examination results
 
The professor can correct material errors on the final records of examination results in accordance with the procedure established in the following sections. These material errors can never be saved with notes, crossed out text or scratched out text on the records.

Section 14. Procedure to amend the records in favour of the student

1.    If the error was noticed before the records were closed by the secretary of the centre, "nula" will be written in the qualitative grade box or in the right margin and a stamp confirming its issuance will be added at the end of the record that will include the student's number on the list of students, his or her complete name, national identity number, passport or equivalent, and the correct grade. This stamp must be signed and must include the place, date, name and title of the professor, professors or members of the corresponding review board, as well as be certified with the signature of the secretary of the centre. The secretary will then publish a copy of the corrected record on the centre's bulletin board.

2.    If the error was noticed after the secretary of the centre closed the records, the professor, professors or members of the review board must apply to the rector for a grade correction using a formalised request form that will be filled out in the centres, with prior approval of their dean or director. Once the amendment has been authorised by a resolution by the rector, the steps indicated in the previous article will be followed.

Section 15. Procedure to correct records to the student's detriment


1.    When the correction is in detriment to the student, the professor or professors in charge of the course will notify the secretary of the centre who will in turn notify the interested party so that within a period of five working days from the notification the student can make allegations. This notification will be made with an acknowledgement of receipt.
2.    If the student does not present any allegations or indicates that they are in agreement, the steps will be the same as those indicated in the previous section.
3.    If the interested party opposes the correction, their allegations will be submitted to the Teaching Organisation Commission of the centre so that they can resolve the issue after meeting with the professor or professor in charge of the course.
3.1    If the records have not yet been closed by the secretary of the centre they will act in accordance to the procedure in section 14.1. This resolution can be appealed before the rector in accordance with the University of La Laguna statutes and Law 30/1992, November 26, on Public Administration and Common Administrative Procedure.
3.2    If the records have already been closed by the secretary of the centre and the Teaching Organisation Commission approves of the amendment, the matter will be given to the rector to resolve. If the rector authorises the amendment the procedure defined in section 14.1 will be followed. The rector's resolution is the final administrative decision; however, it is possible to appeal for a judicial review of this administrative resolution in the Administrative Law Court or to make an appeal for reversal in accordance with Law 30/1992, November 26, regulating Public Administrations and Common Administrative Procedure. 

Section 16. Amending records under special circumstances

In case of sickness, absence or death of the professor or professors referred to in the previous sections, or if they are no longer linked to the university, a professor with a doctorate who is a member of the area or sub-area in which the course is offered will correct the records (except in the case of areas or sub-areas that only offer diplomas). This professor will be designated by the department to which the area or sub-area is attached.

Sole repealing provision

All provisions of equal or inferior rank that contradict this regulation are repealed.

Sole final provision

This regulation will go into affect on the day after it is approved by the Provisional Governing Council and it will be applied to the posterior examinations.
