leyes de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">protecci\u00f3n del medio ambiente\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">es una forma peculiar de com<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">portamiento ilegal, tanto desde\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">un punto de vista jur\u00eddico como psicol\u00f3gico.\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">Las caracter\u00edsticas de este comportamiento\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">hacen que las personas las percibamos de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">una forma determinada y dicha percepci\u00f3n\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">influye en que las llevemos a cabo y en que\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">reaccionemos ante quienes lo hacen. Desde\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">un punto de vista jur\u00eddico, no todos los com<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">portamientos antiecol\u00f3gicos ilegales son deli<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tos. Lo son solo aquellos que aparecen des<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">critos en el C\u00f3digo Penal y que, por tanto, son\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">susceptibles de recibir penas de prisi\u00f3n. Pero\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">las leyes de protecci\u00f3n del medio ambiente\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tambi\u00e9n pueden ser civiles o administrativas\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">y quienes las quebrantan, aunque no puedan\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ser castigadas con ir a prisi\u00f3n, s\u00ed pueden reci<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">bir multas y otras sanciones de importancia\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">capaces de afectar su vida cotidiana (p.e.<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">la demolici\u00f3n de su vivienda). Estas leyes no\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">penales constituyen una legislaci\u00f3n fragmen<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tada, dif\u00edcil de conciliar en muchas ocasiones.\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">Adem\u00e1s, se aplican desde distintas jurisdic<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ciones que implican a los ayuntamientos, los\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">cabildos\/diputaciones y los gobiernos auton\u00f3<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">micos.<\/span><\/p><p>Una misma conducta antiecol\u00f3gica puede ser o no delito, dependiendo de d\u00f3nde se lleve a cabo (p.e., en un espacio no protegido frente a uno protegido); de la cantidad de veces que se realiza (p.e., no es lo mismo deshacerse de una bater\u00eda de coche usada que de cien); de si se produce una vez o se repite, etc. El criterio general es en qu\u00e9 medida se demuestra que\u00a0<span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">el comportamiento juzgado \u201cperjudica grave<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">mente el equilibrio de los sistemas naturales\u201d\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">(Art. 325 del C\u00f3digo Penal). Con fines pura<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">mente expositivos vamos a utilizar el t\u00e9rmino\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">delito ecol\u00f3gico a partir de este punto, aun<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">que siendo estrictos deber\u00edamos hablar m\u00e1s\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">gen\u00e9ricamente de\u00a0 comportamiento anti-eco\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">l\u00f3gico ilegal.<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">\u00a0<\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>\u00abDesde un punto de vista<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>psicol\u00f3gico, las caracter\u00edsticas<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>de los delitos ecol\u00f3gicos hacen<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>que las personas no los perciban<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>como ilegales, ni siquiera como<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>merecedores de reproche\u00bb<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong>\u00a0<\/strong><\/span><\/p><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong><a href=\"https:\/\/www.ull.es\/portal\/hipotesis\/wp-content\/uploads\/sites\/62\/2024\/07\/Captura.png\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.ull.es\/portal\/hipotesis\/wp-content\/uploads\/sites\/62\/2024\/07\/Captura.png\" alt=\"\" width=\"671\" height=\"531\" \/><\/a><\/strong><\/span><\/p><p>Desde un punto de vista psicol\u00f3gico, las caracter\u00edsticas de los delitos ecol\u00f3gicos hacen\u00a0<span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">que las personas no los perciban como ilega<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">les, ni siquiera como merecedores de reproche,\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">porque su malignidad no es tan evidente como\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">en el caso de una violaci\u00f3n o un asesinato. Una\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">primera caracter\u00edstica es que sus consecuen<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">cias se infravaloran porque la mayor\u00eda de las\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">veces no se perciben ni son inmediatas. Pero\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">los delitos ecol\u00f3gicos, como el vertido de sus<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tancias t\u00f3xicas que llegan a acu\u00edferos, tienen\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">efectos que perduran en el tiempo y que aten<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tan silenciosamente contra la diversidad de la\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">fauna y flora y la vida de los seres humanos. En\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">algunos casos ni siquiera las personas expertas se ponen de acuerdo sobre la magnitud\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">del da\u00f1o causado, sobre todo cuando se trata\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">de desastres medioambientales que ocurren\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">por primera vez y sobre los cuales no hay pre<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">cedentes con los que comparar la situaci\u00f3n\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">actual y predecir sus consecuencias a medio o\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">a largo plazo (p. e. el hundimiento del Prestige).\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">La situaci\u00f3n se complica a\u00fan m\u00e1s cuando lo\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">que se castiga no es un da\u00f1o sino el riesgo de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">que ese da\u00f1o se produzca (e.g. encender una\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">bengala en un bosque).<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">\u00a0<\/span><\/p><blockquote><p style=\"text-align: center\"><strong><span style=\"color: #b09e15\">\u00abEn segundo lugar, las v\u00edctimas<\/span><\/strong><br \/><strong><span style=\"color: #b09e15\">de los delitos ecol\u00f3gicos no son<\/span><\/strong><br \/><strong><span style=\"color: #b09e15\">personas individuales, sino un<\/span><\/strong><br \/><strong><span style=\"color: #b09e15\">elevado pero indeterminado<\/span><\/strong><br \/><strong><span style=\"color: #b09e15\">n\u00famero de habitantes de un<\/span><\/strong><br \/><strong><span style=\"color: #b09e15\">territorio y sus descendientes\u00bb.<\/span><\/strong><\/p><\/blockquote><p>En segundo lugar, las v\u00edctimas de los delitos ecol\u00f3gicos no son personas individuales, como en el caso de las violaciones u otro tipo de\u00a0<span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">agresiones, sino un elevado pero indetermina<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">do n\u00famero de habitantes de un territorio y sus\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">descendientes. Hay ocasiones en las que los\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">efectos de una conducta de este tipo no solo\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">se mantienen en el tiempo dentro de un territo<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">rio, sino que traspasan\u00a0 fronteras, en la medida\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">en que el aire y los oc\u00e9anos no tienen barreras.\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">El que no haya una v\u00edctima sino muchas, trae\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">consigo un efecto de difusi\u00f3n de responsabi<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">lidad que hace que muchos delitos ecol\u00f3gicos\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">no se denuncien y que solo se abran expedien<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tes sancionadores si representantes de las\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">administraciones p\u00fablicas (p.e., agentes de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">medioambiente, polic\u00eda ecol\u00f3gica de los ayun<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tamientos) lo hacen.<\/span><\/p><p>Una tercera caracter\u00edstica es que no solo\u00a0<span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">las empresas y las organizaciones crimina<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">les llevan a cabo delitos ecol\u00f3gicos. Tambi\u00e9n\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">incurren en ellos personas sin un perfil delin<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">cuencial. Es el caso de alguien que construye\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">contraviniendo la ordenaci\u00f3n del territorio;\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">que se deshace de escombros y electrodo<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">m\u00e9sticos en un lugar protegido; que hace\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ruido sistem\u00e1ticamente impidiendo el descan<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">so de otras personas; o que quema rastrojos\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">arriesg\u00e1ndose a provocar un incendio forestal.\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">Menci\u00f3n especial merece el maltrato animal,\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ya sea de especies protegidas, de mascotas o\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">de animales de cr\u00eda. La denominada \u201cCrimino<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">log\u00eda Verde\u201d aborda la actividad de organiza<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ciones criminales que se dedican al tr\u00e1fico de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">especies o a la gesti\u00f3n ilegal de residuos peli<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">grosos procedentes de la industria. Tambi\u00e9n\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">se centran en organizaciones no criminales c<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">omo las que llevan a cabo la deforestaci\u00f3n de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">grandes superficies sin tener en cuenta sus\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">consecuencias medioambientales, pero no\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">en los delitos cometidos por personas, como\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">hace la Psicolog\u00eda. La conducta anti-ecol\u00f3gica\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">de una persona aislada puede parecer inocua,\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">pero hay que tener en cuenta que varias con<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ductas semejantes, cometidas por personas\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">distintas, o por una \u00fanica persona en varios\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">momentos en el tiempo, producen un efecto\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">aditivo de una gravedad considerable.<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">\u00a0<\/span><\/p><blockquote><p style=\"text-align: center\"><span style=\"color: #b09e15\"><strong><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">\u00abUna tercera caracter\u00edstica es<br \/>que no solo las empresas y las<br \/>organizaciones criminales llevan a<br \/>cabo delitos ecol\u00f3gicos. Tambi\u00e9n<br \/>incurren en ellos personas sin un<br \/>perfil delincuencial\u00bb.<\/span><\/strong><\/span><\/p><\/blockquote><p>P<span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">or \u00faltimo, las sanciones que la ley esta<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">blece para los delitos ecol\u00f3gicos si bien son\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">duras, raramente se imponen, ni en Espa\u00f1a\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">ni en pa\u00edses de nuestro entorno. Las penas\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">de prisi\u00f3n son muy excepcionales siendo las\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">sanciones m\u00e1s frecuentes las multas. Des<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">graciadamente, cuando el transgresor es una\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">empresa, incluso las multas de gran cuant\u00eda\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">suelen constituir una inversi\u00f3n menor que el\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">gasto que supondr\u00eda desarrollar legalmente\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">su actividad cotidiana, de modo que transgre<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">dir las leyes de protecci\u00f3n del medio ambiente\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">compensa econ\u00f3micamente.<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">Aunque estas peculiaridades son comunes\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">a todas las conductas antiecol\u00f3gicas ilegales,\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">las personas diferencian espont\u00e1neamente\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">entre al menos tres tipos a la hora de valorar<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">las: construcciones, vertidos y atentados con<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">tra la flora y la fauna. Este \u00faltimo tipo, el com<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">portamiento antiecol\u00f3gico ilegal contra la flora\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">y la fauna, recientemente ha sido objeto de\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">especial atenci\u00f3n desde la legislaci\u00f3n penal\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">espa\u00f1ola, dando lugar a una reforma legal\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">sustentada en el hecho de que los animales\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">han pasado de ser propiedades a ser consi<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif\">derados seres sintientes.
