THE WATER REUSE AS A PUBLIC SERVICE (EXPERIENCE FROM CANARY ISLANDS WATER ACT)

European Regulation 2020/741 establishes a set of obligations on water reuse that raise the
question of whether compliance requires the implementation of a new public service. Since
1990, the Canary Islands Water Law of 1990 declares the reuse of water a public service. This
work analyzes the meaning of that legal declaration, the reasons behind and its effectiveness
in the years since its approval. That reference allows identify the elements that are necessary
so that water reuse could be configured as a public service.

Real estate timesharing is a recently created right that is characterized by the concurrence of
personal, real and formal elements. In addition to the fulfilment of certain prerequisites, we
can add that it is a right with its own legal regime in terms of constitution, modification,
content, duration or termination. Moreover, the right of withdrawal and the prohibition of
payment of advances offer consumers special protection.

THE POTENTIAL VIOLATION OF PRIVACY, PERSONAL IMAGE, AND DATA PROTECTION RIGHTS THROUGH THE USE OF SURVEILLANCE DEVICES IN HOMEOWNER ASSOCIATIONS

This paper seeks to provide a critical and reflective approach to the possible violation of the
rights to privacy, own image, and personal data protection through the use of video surveillance
devices in communities of property owners under horizontal property regime. The
legal framework applicable to these rights in residential communities will be examined, and
new forms of video surveillance that may disrupt these rights in the future will be identified,
including the Internet of Things, video doorbells, drones, and thermal cameras. The central
topic of the paper will be examined through the analysis of the installation and use of video
surveillance systems through agreements of the property owners’ association, as well as by
individual property owners.

El presente trabajo analiza la responsabilidad civil del médico en Italia en cuanto es un
tema de creciente interés tanto a nivel jurídico como social. Esta investigación propone un
análisis detallado de la responsabilidad civil del médico en diferentes contextos jurídicos,
prestando especial atención a su evolución a lo largo del tiempo y a las perspectivas futuras.
El trabajo comienza con un examen exhaustivo de los fundamentos conceptuales y jurídicos
de la responsabilidad civil del médico, analizando los sujetos involucrados y los principios
fundamentales que rigen la responsabilidad médica, incluida la relación contractual con el
paciente. Posteriormente, se revisan las distintas etapas de la evolución de la jurisprudencia a
lo largo del tiempo y las reformas sucedidas hasta la normativa actual. Finalmente, se realiza
un breve análisis comparativo de la responsabilidad médica en diferentes jurisdicciones del
ordenamiento europeo para ofrecer al lector una visión integral sobre la materia.
