En ese subproyecto se va a estudiar y analizar qu\u00e9 se entiende por derecho transnacional colectivo del trabajo, analizando adem\u00e1s los conflictos de leyes y de jurisdicciones en el marco de las relaciones de trabajo colectivas conectadas con m\u00e1s de un ordenamiento jur\u00eddico y, adem\u00e1s, desde todas los ejes considerados principales en este sentido: la representatividad de los sindicatos a escala supranacional; las cuestiones relacionadas con la auto-regulaci\u00f3n de los procesos de negociaci\u00f3n para alcanzar determinados convenios colectivos at\u00edpicos de car\u00e1cter transnacional y finalmente, toda la materia relativa a la autoprotecci\u00f3n y defensa de los intereses de los trabajadores en el contexto supranacional, m\u00e1s en concreto, las cuestiones relacionadas con las denominadas acciones industriales transfronterizas. Todo ello sin perder de vista las implicaciones sociales y econ\u00f3micas de estos procesos. Son objetivos espec\u00edficos del mismo:<\/p>\n

  1. Estudiar la naturaleza, contenido y r\u00e9gimen de funcionamiento de los denominados acuerdos marco internacionales, los convenios colectivos transnacionales y los productos del di\u00e1logo social europeo<\/li>\n
  2. Estudiar la estructura y la organizaci\u00f3n de la negociaci\u00f3n colectiva at\u00edpica a nivel europeo e internacional<\/li>\n
  3. Estudiar los c\u00f3digos de conducta y las gu\u00edas de buenas pr\u00e1cticas a nivel europeo e internacional, especialmente desarrollados en el \u00e1mbito del transporte<\/li>\n
  4. Estudiar las acciones colectivas internacionales y la responsabilidad extracontractual de los sindicatos en su convocatoria y ejecuci\u00f3n<\/li>\n
  5. Analizar la jurisprudencia europea e interna donde se estudia la participaci\u00f3n sindical en acciones que tienen como objetivo forzar determinadas condiciones de trabajo en el marco de convenios o acuerdos internacionales.<\/li>\n<\/ol>\n

    En particular, analizar si algunos recientes pronunciamientos judiciales pueden interpretarse como una correcci\u00f3n de la doctrina sentada en los asuntos Viking y Laval.<\/p>\n

    In this subproject we will study and analyse what the transnational collective labour law is, taking into the account the conflicts of law and jurisdiction in the framework of collective labour relations connected to more than one estate. This study will be done from all the different and possible approaches, such as the degree of representativeness of trade unions in the international level, the auto-regulation in the collective negotiation processes in order to reach different types of atypical collective agreements in the transnational level and the autoprotection of the workers interests in the international context, in the framework of the so called transnational collective industrial action. Also, we will take into account the social and economic implications of these processes. The specific objectives are the following:<\/p>\n

      \n
    1. To study the nature, content and legal status of the international framework agreements, the transnational and European collective agreements and the European social dialogue<\/li>\n
    2. To study the structure and organization of the international atypical collective bargaining in the International and European level.<\/li>\n
    3. To study the codes of conduct and guides to good practice in the European and international level, especially in the field of transport.<\/li>\n
    4. To study the international collective actions and the non-contractual liability of trade unions for that actions.<\/li>\n
    5. To analyse European and domestic case law on the trade union participation in actions in order to impose certain working conditions in the framework of national or international collective agreements.<\/li>\n<\/ol>\n

      Particularly, one on the main objectives is to analyse if some recent case law is correcting the Viking and Laval doctrine.<\/p>\n
