Brands

It is a distinctive sign that distinguishes the products or services of a company in the market, whether it is an individual or social entity.

The applications of brands National trademarks are managed through the OEPM (Spanish Patent and Trademark Office). The duration of the right is 10 years renewable.

What CANNOT be registered as distinctive sign?

  • Generic name: signs that describe the products or services.
  • Geographic origin indicators.
  • Signs contrary to public order.
  • Signs that lead to deception.
  • Signs identical or similar to others already registered, for similar products or services.
  • Signs that take advantage of others already registered.
  • Images or names of third parties, without the owner's authorization.

Industrial Design

It is a type of industrial property that protects the three-dimensional (models) and two-dimensional (drawings) external form.

To grant industrial design protection, two requirements must be met:

  • That it be new: when no identical drawing or model has been made public.
  • That it has a unique character: when the overall impression it produces on informed users differs from the overall impression produced by any other drawing or model that has been made public.

Plant Varieties

The Community Plant Variety Office (CPVO) It is responsible for granting plant variety protection rights in the EU. It promotes innovation through applications for Community protection of plant varieties and provides advice and assistance to stakeholders in exercising their rights. Protecting new plant varieties across the EU helps to safeguard the interests of breeders and ensures the return on their investments in research and innovation.

The duration of these rights to new plant varieties, valid in EU countries, is 25 years (30 years for potato, vine and tree species).
