Seminar. Children's and adolescents' rights: towards an autonomous discipline within Family Law

February 12-10:30 am - 12:30 pm

With the progressive incorporation into our legal system of structural principles such as the best interests of the child, the right of children and adolescents to be heard, and the recognition of evolving capacities, family law has undergone a substantial transformation in its theoretical foundations and traditional categories. These principles, enshrined in international instruments—most notably the 1989 Convention on the Rights of the Child—as well as in national and regional legislation, have challenged the classical approach to family law, historically constructed from a predominantly adult, guardianship-based, and patrimonial perspective.

This paradigm shift has meant a transition from a model centered on authority and protection understood in welfare terms, towards a model based on the recognition of the child and the girl as a subject with full rights, with the progressive capacity to participate in decisions that affect them. In this context, notions such as the ownership and exercise of fundamental rights by children, effective participation in administrative and judicial proceedings, and the need to consider their best interests as a hermeneutical and decisional criterion, acquire a central role in the interpretation and application of contemporary family law.

From this perspective, we will invite qthose who attend to reflect critically on the evolution of Family Law and its current challenges, while offering them a first systematic approach to the legal discipline of "Children's and Adolescents' Rights", understood as a transversal area of the legal system that integrates contributions from Civil, Constitutional, International and Administrative Law, and that requires a reinterpretation of the classic legal categories in light of the fundamental rights of children and adolescents.
